Common zoning terms are defined below. Additional zoning definitions, as well as explanations, are provided within the Evansville Zoning Ordinance. Conditional Use means certain uses in situations which are of such a special nature, or are so dependent upon actual contemporary circumstances, as to make impractical the predetermination of permissibility, or the detailing in this chapter of specific standards, regulation, or conditions which would permit such determination in each individual situation, may be permitted as conditional uses.

Development means any manmade change to improved or unimproved real estate, including but not limited to the construction of buildings, structures or accessory structures; the construction or additions or substantial alterations to buildings, structures or accessory structures; the placement of buildings or structures; ditching, lagooning, dredging, filling, grading, paving, excavation or drilling operations; and the deposition or excavation of earthen materials.

Nonconforming structure means a building or premises lawfully used, occupied or erected at the time of the passage of the ordinance from which this chapter is derived or at the time of an amendment thereto, which does not conform to the regulations of this chapter with respect to frontage, width, height, area, yard, parking, loading or distance requirements.

Nonconforming use means the use or occupancy of a building or premises, which is lawful at the time of enactment of the ordinance from which this chapter is derived or at the time of enactment of amendments thereto, but which use or occupancy does not conform to the provisions of this chapter or any amendments thereto.

Permitted use. Uses listed under this heading are permitted as of right. This means that an applicant for a building permit shall be given a permit if he or she meets the other requirements of the chapter, e.g., yards, setbacks and so forth.

Variance means authority granted to the owner to use his or her property in a manner which is prohibited by this chapter. A variance is a departure from the terms of this chapter where it is shown that unique physical circumstances applying to a land parcel cause a hardship to the owner and that the condition permitted by the departure still will be in fundamental harmony with surrounding uses.
